MONSON-SULTANA JOINT UNION ELEMENTARY SCHOOL DISTRICT Sultana, California
DESCRIPTION OF WORK: The work includes several optional variations of modular buildings as described in the bid form. BASIS FOR BIDS: Bids shall be on unit price basis with reference to floor plans and elevations provided by district.
TIME OF COMPLETION: The work shall be completed within 150 calendar days from the date of the owners notice to proceed. SUBMISSION OF BID PROPOSALS:
.1 ID PROPOSALS: Submit bid proposal on the form supplied by district in a sealed envelope marked with the project title to the MONSON- SULTANA Elementary School District, 10643 Avenue 416, Sultana, CA 93666, California on or before February 4th, 2021 at 4:00 PM
.2 DVBE DOCUMENTATION: The three lowest bidders shall submit in a sealed envelope bearing on the outside the name of the bidder, the bidder’s address, and the name of the Project, the Prime Bidder Good Faith Effort Worksheet and the Prime Bidder Certification of Disabled Veteran Business Enterprise Participation on or before February 4th, 2021 at 4:00 PM in the Monson Sultana Elementary School district, 10643 Avenue 416, Sultana, CA 93666.
OPENING: All interested parties are invited to attend the opening of proposals which will be at the Monson Sultana Elementary School Dis- trict office, 10643 Avenue 416, Sultana, CA 93666, on February 4th, 2021 at 4:01 PM. Only bids received by 4:00 PM will be considered. EXAMINATION AND PROCUREMENT OF CONTRACT DOCUMENTS: Contract documents have been prepared by SIM Architects, 10643 Avenue 416, Sultana, CA 93666, (661) 825-9270, Monday through Thursday between 8:00 AM and 5:00 PM and Friday between 8:00 AM and 12:00 PM. Documents may be examined and obtained at the Districts office.
Only bona fide general contract bidders may secure copies of the proposed contract documents from the District on the following basis: .1 Limited to two sets of specifications and drawings, upon payment of $350.00 deposit per set payable to Monson Sultana Elementary School District., completely refundable if sets are returned to the District in good condition within seven calendar days after bid opening. .2 A nonrefundable charge of $20.00 made by separate check will be required for all sets requiring shipping and handling.
.3 Additional complete sets may be purchased from the architect at the price of 1.15 times the Districts cost of reproduction and delivery. .4 Specifications and drawings will also be issued to various Builders Exchanges for subcontractors use or subcontractors may purchase complete sets from the district at the price of 1.15 times district’s cost of reproduction and delivery. Purchase sets are non-refundable.
.5 No partial sets or individual sets will be issued or sold.
SUBSTITUTIONS: Pursuant to public contract code section 3400, manufacturer’s shall submit request to the district, not less than 10 days prior to bid (if material is to be included on final addendum), and not later than 35 days after the award of the contract, all data substantiat- ing a request for substitution of materials. In order to be considered, substitutions of materials or equipment must comply with requirements specification Section 1 2500, including providing comparative data and samples.
BID SECURITY: Submit bid security with proposal, made payable to Owner, in amount of 10% of the Bid, in the form of certified check, bid bond, cashier’s check or cash. Bid security will be retained until agreement is signing required bonds furnished. If any bidder refuses to sign the agreement form within seven days after award, the Owner will retain his bid security as liquidated damages. To enable compliance with California code of Civil Procedure 995.311, each contractor shall provide, prior to contract award, print out of information from the Department of Insurance website HTTP://www.insurance.ca.gov/ confirming the surety is in admitted surety insurer.
QUALIFICATION OF BIDDER: The Owner will not consider or accept any bids from modular manufacturers who are not licensed to do busi- ness in the State of California, in accordance with the Public Contract Code of the State of California, providing for the licensing of contrac- tors. In accordance with section 3300 of said code, the contractor shall have a Class B license.
AWARD: The owner reserves the right to reject any and all bids and or waive any informality in any bid received and or determine its discre- tion the responsibility of any bidder, an which bid is most advantageous to the owner. Unless otherwise required by law, no bidder may withdraw his bid for period of 60 days after the date set for the opening thereof.
PREVAILING WAGES: The project is a public work, the work shall be performed as a public work, and under California Labor Code Section 1770 et seq., the Director of the California Department of Industrial Relations (DIR) has determined the general prevailing rate of per diem wages and the general prevailing rate for holiday and overtime pay work in a locality in which the workers to perform, for each craft, clas- sification or type of work are needed to execute this contract. Per diem wages shall be deemed to include employer payments for health and welfare, pension, vacation, apprenticeship or other training programs, and similar purposes. Copies of the rates are on file at the owner’s principal office, the rate of prevailing wage for any craft, classification or type of workmanship to be employed on this project is the rate es- tablished by the applicable collective bargaining agreement which rate so provided is hereby adopted by reference and shall be effective for the life of this agreement or until the director or the DIR determining determines at another rate be adopted. It shall be mandatory upon the contractor and on the subcontractor to pay not less than the said specified rates to all workers employed in the execution of this agreement. The contractor in any subcontractor under the contractor as a penalty to the owner shall forfeit not more than $200 for each calendar day or portion thereof for each worker paid less than the stipulated prevailing rates for each for such work or craft in which such worker is employed. The difference between such stipulated prevailing wage rates and the amount paid to each worker for each calendar day or portion thereof for which each worker was paid less than the stipulated prevailing wage rate shall be paid to each worker by the contractor.
DIR REGISTRATION: As of February 4th, 2021, the contractor and any proposed contractors shall not be qualified to submit a bid or to be listed in a bid/GMP proposal for the project and less currently registered and qualified under Labor Code section 1725.6 to perform public work as defined by division 2, part 7, chapter 1 of the Labor Code. As of April 1st, 2015, the contractor and any proposed set protesters should not be qualified to enter into, or engage in the performance of, this agreement unless currently registered and qualified under Labor Code sections 1725.5 to perform public work projects.
PAYROLL RECORDS: The contractor in each subcontractor shall keep or cause to be kept an accurate record for work on this project showing the names, addresses, Social Security numbers, work classification, straight time and overtime hours work and occupations of all laborers, workers and mechanics employed by them in connection with the performance of this contract or any subcontract there under, and showing also the actual per diem wage paid to each of such workers, which records shall be open at all reasonable hours to inspection by the owner, its officers and agents and to the representatives of the division of Labor standards enforcement DIR.
LABOR COMPLIANCE PROGRAM: Contractor and all subcontractors shall comply with Labor Code section 1776. In accordance with Labor Code section 1771.4 (a)(1), the project is subject to compliance monitoring and enforcement by the DIR. The contractor and each sub-con- tractor shall furnish a certified copy of all payroll records directly to the labor commissioner on a monthly basis, unless directed by the owner to furnish such records more often, and in the formal prescribed by the labor commissioner.
RETENTION FUND: Pursuant to Public Contract Code Section 22300, the contractor may, upon request, at its own expense, deposit with owner or with a state or federally Chartered Bank as the escrow agent, securities equivalent to the amount withheld. Such securities, if deposited by the contractor, shall be valued by the owner, whose decision on valuation of the security shall be final. Securities eligible for in- vestment under this provision shall be limited to those listed in section 22300 of the Public Contract Code and section 16430 of the California Government Code. Upon such deposit, owner shall pay such monies withheld to the contractor, upon satisfactory completion of the contract, the securities together with any interest thereon shall be returned to the contractor.
.1 Alternatively, the contractor may elect to enter into an escrow for the deposit of securities and/ or funds withheld to ensure performance of the contract.
.2 Any escrow used shall be established using the escrow agreement form specified in the contract documents.
FINGERPRINTING REQUIREMENTS: Contractors, subcontractors and their employees shall comply with Education Code Sections 45125.1 and 45125.2. Such entities are responsible for ensuring full compliance with the law and should therefore review all applicable statutes and regulations. Bids must be accompanied by an executed fingerprinting notice an acknowledgment.
DSA OVERSIGHT PROCESS: The contractor shall comply with the application requirements for the Division of State Architect (DSA) Con- struction Oversight Process, including but not limited to a notifying the project inspector upon commencement and completion of each aspect of the work as required under DSA form 156: (b) coordinating the work with the project inspectors inspection duties and requirements: (c) submitting verified reports under DSA form 6E: (d) coordinating with the owner, owners architect, any construction manager, any laboratories, and the project inspector to meet the DSA oversight process requirements without delay or added cost to the project.
DVBE REQUIREMENTS: The owner will require the successful bidder to achieve the minimum goal of 3% Disabled Veteran Business Enter- prises (DVBE) established in the bidding documents or to provide acceptable advanced evidence of good faith efforts to do so.
QUALIFIED BIDDER LIST: Pursuant to public contract code section 20111.6, all general contractors and mechanical, electrical and plumb- ing subcontractors and license classifications capital A comma capital B, capital C-4, capital C-7, capital C-10, capital C-16, capital C-20, capital C dash 34, capital C dash 36, capital C dash 38, capital C dash 42, capital C dash 43, and capital C-46 who intend to bid on the project must be pre-qualified. No bid will be accepted for such projects from subcontractors in the listed license categories that are not on the owners qualified bidder list.

Sealed proposals will be received at the office of the City Clerk, 1700 Seventh St., Sanger, California 93657, until 11:00 A.M., February 17, 2021, at which time they will be publicly opened and read in said building for construction in accordance with the specifications therefor, to which special refer- ence is made as follows:
No bidder may withdraw his/her bid within 30 days after the actual date of the opening thereof. Planholder names may be obtained only from the City Engineer, beginning six working days prior to the date of bid opening.

Bids shall be submitted in a sealed envelope addressed to the City Clerk labeled with the name of the bidder, the name of the project and the statement ‘Do Not Open Until The Time of Bid Opening.’ No bid will be considered unless it is made on proposal form furnished by the City Engineer. Each bid must be accompanied by a certified or cashier’s check or bidder’s bond, made payable to the City of Sanger, for an amount equal to at least ten percent (10%) of the amount bid. A Performance Bond in the amount equal to one hundred percent (100%) of the contract amount and a Labor and Materials Bond in the amount equal to one hundred percent (100%) of the contract amount will be required by the City from the bidder to who the contract is awarded.
No contract will be awarded to a Contractor who has not been licensed in accordance with the provi- sions in Chapter 791, Statutes of 1919, as amended, or whose bid is not on the proposal
form included in the contract documents. A valid California Class A Contractor’s License is required for this project.
Bidders are advised that, as required by Federal Law, the City is implementing new Disadvantaged Business Enterprise (DBE) requirements. These requirements are addressed in the project specifica- tions. The DBE Contract goal for this project is 13.0 %.
The City of Sanger hereby notifies all bidders that it will affirmatively insure that in any contract en- tered into pursuant to this advertisement, Disadvantaged Business Enterprise (DBE), Minority Busi- ness Enterprise, and Women-Owned Business Enterprise will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, religious creed, sex, or national origin in consideration for an award.
This project is subject to the Buy America provisions of the Surface Transportation Assistance Act of 1982 as amended by the Intermodal Surface Transportation Efficiency Act 0f 1991.
In accordance with the provisions of Section 1770 of the Labor Code, the Director of the Department of Industrial Relations of the State of California has determined the general prevailing rates of wages and employer payments for health and welfare, pension, vacation, travel time, and subsistence pay as provided for in Section 1773.8, and similar purposes applicable to the work to be done. Said wage determinations are on file with the City Clerk, City of Sanger, 1700 Seventh Street, Sanger California, and are incorporated herein by reference.
Minimum wage rates for this project, as predetermined by the U.S. Department of Labor, are set forth in the Appendix. If there is a difference between the minimum wage rates predetermined by the U.S. Department of Labor and the Prevailing Wage Rates determined by the Director of the Department of Industrial Relations of the State of California for similar classifications of labor, the Contractor and his subcontractors shall pay no less than the higher wage rate.
No contractor or subcontractor may be listed on a bid proposal for a public works project unless registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5[with limited exceptions from this requirement for bid purposes only under Labor Code section 1771.1(a)]. No contractor or subcontractor may be awarded a contract for public work on a public works project unless registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5. This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations.
Bids are required for the entire work described herein. Bids will be compared on the basis of the total bid items.
The City Council reserves the right to reject any or all bids to waive any informality in the bids received or to award the contract to the lowest responsible bidder as may serve the best interests of the City of Sanger.
