Section 1. SUMMONS
1. The College Committee on Discipline (CCD)
The Respondent shall be required to answer within a non- extendible
period of time (5) days from receipt of the summons. If the respondent fails
to answer within the time frame for him to answer, he/ she is deemed to have
waived his/ her right to present his/ her side.
After the answer had been submitted, the College Committee on
Discipline (CCD) may summon both parties for clarificatory questions in
determining whether there is a prima facie case.
In the event that the College Committee on Discipline (CCD) finds no
prima facie case, the Committee shall dismiss the case. If the College
Committee on Discipline (CCD) finds a prima facie case, it will issue a Formal
Charge. The finding of whether or not there exists a prima facie case by the
College Committee on Discipline (CCD) is final and not appealable.
Section 2. PRELIMINARY MEETING
Within one week after the receipt of the answer or after the expiration
of the period within which to file answer, the preliminary meeting shall be
held.
The Matters
1. The possibility of amicable settlement.
2. Stipulation of the facts.
3. Marking of evidence.
4. Witnesses.
5. Dates of hearing and other matters for the speedy resolution of
the case.
- Any agreement shall be reduced in writing which shall be
binding between the parties.
- If the Complaint failed to appear, it will be a ground for the
dismissal of the complaint.
