8. TERMINATION – USTDI shall have the right to terminate this contract
upon, but not limited to, any or all of the following grounds:
a. Unsatisfactory or below par performance of the
EMPLOYEE, as determined by USTDI, negligence, disobedience,
misconduct, misbehavior, imprudence, drunkenness, alcoholism, substance
abuse, and/or inappropriate conduct or act in any form, way or manner that
may prejudice USTDI, its owners, directors, officers and/or personnel in
any way, such prejudice including but not limited to business loss or
prejudice, acts adversely affecting the operations and/or processes of
USTDI, USTDI’s loss of goodwill and/or its adversely affected business
reputation, embarrassment to USTDI, and other forms and manner of
prejudice;
b. Breach of any provision of this Contract, unless waiver in
writing is made by USTDI;
c. Loss of trust and confidence in the EMPLOYEE;
d. EMPLOYEE makes an unauthorized use of tools and
equipments; and
e. Filing of any suit, civil or criminal, by the EMPLOYEE
against USTDI, and/or any of its owners, directors, officers and/or
personnel.
f. Unable to meet the minimum quota, company has the right
to terminate the contract within 24 hrs (see attached agreed minimum
quota).
Should any of the aforecited grounds arise, USTDI shall have the right to terminate
this Agreement upon the giving of a notice in writing to the EMPLOYEE. The notice shall
be served personally, or by registered mail at the above-written address of the
EMPLOYEE, unless he has notified USTDI in writing of any change in his address. This
termination shall be without prejudice to any other right or remedy that USTDI may have
against the EMPLOYEE in law or equity.
In the event that the EMPLOYEE is terminated or resigned from the company, the
EMPLOYEE shall surrender all or allow USTDI to buy back his company uniforms at
twenty percent (20%) of the purchase price.
