Appendix D - legal framework


            and consent – children




            Children are defined as not yet having reached
            their 18th birthday.
            The Children’s Act 2004 and Working Together to
            Safeguard Children 2015 defines ‘safeguarding and
            promoting the welfare of children as:
            •  Protecting children from maltreatment.
            •  Preventing impairment of children’s health and
              development.
            •  Ensuring that children are growing up in
              circumstances consistent with the provision of
              safe and effective care.
            •  Taking action to enable all children to have the
              best outcomes.
            Consent

            Consent is not required for Safeguarding referrals
            where children are concerned, however, it is
            imperative for the safety of the child and yourself
            that you contact the Pharmacy Superintendents’
            office for further advice.
