AGENCY RELATIONSHIP
The responsibility of the real estate agent is defined by the state law relating to agents, the
REALTORS® Code of Ethics, and general principles of agency law. The type of relationship formed
between the agent and the client is called a fiduciary relationship. The agent owes the following
duties to the client: Loyalty, Obedience, Diligence, Disclosure, Confidentiality, Accountability and
Reasonable Skill & Care.
Why Sellers should use a Seller’s Agent
A seller’s agent acts solely on behalf of the seller. A seller’s agent has fiduciary duties to the
seller which include reasonable care, undivided loyalty, confidentiality, and full disclosure.
Responsibilities of a Seller’s Agent include:
Provide a comprehensive market analysis to determine the optimal listing price for your
home.
Create and execute a customized marketing strategy, including professional
photography, online exposure, print materials, open houses, and targeted outreach.
Offer staging advice and recommendations to maximize your home’s appeal and value.
Coordinate and schedule all property showings, ensuring security and proper
representation of your home.
Present all offers promptly and advise on their strengths and weaknesses.
Negotiate the highest possible price and best terms for the seller.
Keep your personal and financial information confidential.
Manage all communications with prospective buyers and their agents to ensure smooth
and professional interactions.
Monitor all dates, deadlines, and requirements to keep the transaction on track through
closing.
