Employment Law Update
The Equal Employment Opportunity Commission (EEOC) released new guidance for employers regarding
workplace harassment and discrimination, the first in more than 30 years. Although non-binding, the guidance
provides a blueprint for EEOC Title VII enforcement and lays out employer obligations under the statute,
particularly regarding sexual orientation and gender identity discrimination and harassment.
What’s New?
According to the Commission, the following could trigger Title VII liability:
» Intentional and continued refusal to use preferred » Complaining of favoritism when an employee is

These are only a few examples of what is newly covered. The guidance provides dozens of hypothetical examples of
Title VII-triggering harassment and discrimination. We strongly encourage all MIL managers and supervisors to stay
abreast of these important guidelines.
Every October, MIL conducts annual Workplace Discrimination and Harassment Prevention Training. Consistent
training and 100% participation, regarding company harassment and discrimination policies is critical to ensure
Title VII compliance and mitigate any potential backlash from employees.
