Labor Day: Did you know?
The U.S. Department of Labor (DOL) was established as a result of a half-century campaign by
organized labor for a “Voice in the Cabinet” and was influenced by the Progressive Movement.
The Department’s mission is to “foster, promote, and develop the welfare of working people,
improve their working conditions, and enhance their opportunities for profitable employment.”
The DOL administers and enforces over 180 federal laws and thousands of federal regulations,
ensuring that workplaces across the country remain safe and fair.
Five DOL Employment Laws Every Manager Should Know:
Fair Labor Standards Act (FLSA)
» Overview: Supervisors must ensure employees are paid according to the law, especially regarding
overtime. It’s crucial to correctly classify employees as exempt or non-exempt and to work with HR
before making changes to job duties that could affect exemption status.
Family and Medical Leave Act (FMLA)
» Purpose: Provides job-protected leave for family and medical reasons.
» Supervisor Responsibilities: Refer employees to HR when they request leave for medical reasons.
Remember, employees don’t need to mention “FMLA” to be protected under the law.
Occupational Safety and Health Act (OSHA)
» Requirement: Employers must comply with safety standards set by OSHA and ensure the
workplace is free from recognized hazards.
Executive Order 11246
» Requirement: Prohibits discrimination by certain federal contractors and subcontractors based on
race, color, religion, sex, sexual orientation, gender identity, or national origin.
Uniformed Services Employment and Reemployment Rights Act (USERRA)
» Requirement: Employers must inform employees of their rights under USERRA, which protects
service members’ employment rights.
