g) the fact that MHML maintain that Mrs Hillgarth did expect certain workings which she considered to be included in the Schedule of Works and were costed in by AR Lawrence for them to perform
h) the fact that it now appears that Mrs Hillgarth did not request or expect any workings to be done outside of the Schedule of Works
i) the fact that it now appears that MHML stated in correspondence that Mrs Hillgarth was insisRng that certain items within the Schedule of Works should be excluded in order that other improvements outside of the Schedule of Works could be included
j) the fact that MHML illegally debited a debt due from Mrs Hillgarth to MHML for an outstanding RTM costs invoice in lieu of a payment made to all Directors for a 25% share of lease extension monies received.
k) the fact that MHML were illegally charging fees for Rme and costs in managing Mitre House since 2012
l) the fact that MHML (Paul Brown-Constable) organised, arranged and managed addiRonal workings outside of the Schedule of Works using funds saved from the
agreed s.20 budget of £105,019 without first gaining permission from the other leaseholders.
m) the fact that Paul Brown-Constable physically performed many workings outside of the Schedule of Works, whilst remaining within the agreed budget (plus £858 overspend) without the approval of other leaseholders.
n) the fact that despite a request from Mrs Hillgarth on 17 December 2015 to view invoices from the 2014 Accounts dated 30 May 2015, Paul Brown-Constable refused her request staRng the statutory 6 month limit for access.
o) the fact that allegedly other lessees also made requests for informaRon which was not supplied (Mr Leigh-Pemberton since May 2015 and Mr FortunaR on 17 and 21 December 2015)
k)_ In the s22 NoRce from Solicitor Begg to MHML dated 26 August 2016 - he writes:
In the latest le)er from Mr Begg to Mr Brown-Constable dated 7 July 2016 (Item 13) Mr Brown-Constable was asked (a) How much had been charged by him personally to MHML for the work he did on the refurbishment? (b) What profit did MHML make on the £31,765.21 it charged to the lessees for the refurbishment? In other words what was the difference between the £31,765.21 it charged to the lessees and the total amount paid by MHML to its sub-contractors? In his le)er dated 7 July 2016, with comments superimposed on Mr Begg's le)er of the same date (see Item 14) Mr Brown-Constable simply responds to each quesRon: "t don't consider that a valid query". It is believed that the reason for this evasive response is that these quesRons cannot be answered truthfully without admilng fraud.
