Thank you for your further two phone-calls around 8.00pm on 9th August in response to my letter of 8 August.
Due to various reasons I have not been able to employ my full resources to your Draft (Crime) Report, which, bearing in mind it’s seriousness and inaccuracies does require my full and uninterrupted attention. I regret that both health and holidays are to blame but I can assure you it will receive my full perusal and comments and supporting paperwork promptly after a short holiday terminating after the upcoming August Bank Holiday week-end.
I will, though, await your documents as stated in your phone calls with some anticipation and trepidation.
In the meantime, it has recently come to our attention that your client’s Tenancy Agreement issued to her prospec- tive tenants of Flat 5, Mitre House, for signing off (a document we have never perused despite a requirement for her to supply one when seeking permission to sub-let as indicated in her lease) might not be as comprehensively thorough, honest and correct as others which our previous Agents had sight of from various other fully compliant lessees and those we ourselves have researched to very good effect.
We suggest you closely peruse a copy of your client’s own Tenancy Agreement issued to her tenants for signing off, paying particular attention to any references to her lease covenants, as we have serious doubts as to the authenticity and veracity of her particular Tenancy Agreement when viewed alongside others we hold on file which would indicate an impossibility to sign and approve a Tenancy Agreement without having first gained permission.
I refer in the first instance to “Consents” - The Landlord confirms that all necessary consents have been obtained to enable the Landlord to enter into this agreement (whether Superior Landlord, Lenders, Mortgagees, Insurers or others).
As you are well aware, Mrs Hillgarth has never to my knowledge requested permission to sub-let from ourselves or indeed our previous Agents despite frequent requests to oblige, and as such we have never had the privilege of perusing and validating her Tenancy Agreement for errors and omissions or indeed misrepresentations.
We await your comments on what might be very serious dishonest misrepresentations perpetrated on your client’s tenants and if we are correct, a very serious misfeasance placing MHML in harm’s way.
I need hardly remind you that Mrs Hillgarth was a Director of MHML from October 2011 until September 2014. Yours sincerely,
