Reference your request following the email sent round-robin by Michele Hillgarth on Friday 14th October around
6.45pm to all lessees. I am hopeful that this pdf letter and the additional documents are self-explanatory. Answers to Mrs Hillgarth’s queries are attached to the copy of the email she felt necessary to send to all lessees.
As most lessees are aware, relationships between Mrs Hillgarth and Management, most especially myself have never been good, nor indeed was her relationship with previous Agents as correspondence on file amply evidences.
Nevertheless, she, like any lessee, is entitled to make valid comment, complaint or request to whoever is presently acting as Management. What your present Management has experienced since taking charge is neither valid comment, complaint or request but scurrilous, ill-informed and obstructive behaviour which her email of 14 October is a perfect example. Mrs Hillgarth is simply intent on bringing Management into disrepute for reasons best known to herself.
Mrs Hillgarth commenced proceedings against Management on 23 March this year, which has resulted in reams of correspondence with her Solicitor, the most recent of which was dated 23 September 2016 and replied to on 29 September 2016. Her Solicitor’s letter of 23 September was identical in content and query as to Mrs Hillgarth’s 14 October email sent to all lessees. I have attached a copy of our reply dated 29 September.
For further clarification, I would remind you that in late 2011 and early 2012, Management both sourced and recom- mended individual suppliers as opposed to one main contractor for the Interior works. Reason; 35-50% cheaper. Mrs Hillgarth disagreed and sourced alternative main contractor quotes of approx. £60,000. Management’s same individual suppliers totalled £35,000 for the exact same works. Mrs Hillgarth’s £60,000 for just interior works (but with Exterior costs estimated at £70,000 plus) required a contribution from each lessee of approx. £5000-£7500 each to amply cover both Interior & Exterior works. Management requested confirmation to contribute from each lessee but none was forth- coming. Mrs Hillgarth insisted that Interior & Exterior works be done over two years as opposed to concurrently. This was not feasible due to various reasons as well documented. Mrs Hillgarth made an application for a Right To Manage which delayed works yet further during 2013 resulting in an eventual agreement to commence both Interior & External works in late 2014 for thankfully £105,000 as opposed to using Mrs Hillgarth’s preferred contractor, Wade, for £219,000.
Neither Wade’s £219,000 nor the finally agreed £105,000 budget included the £60,000 works that Mrs Hillgarth had sourced in 2012 or the same works that Management had costed for £35,000, as they were just unaffordable seeing as even the £105,000 budget required a £2000 per lessee contribution to amply fund and have some funds in Reserves.
Mrs Hillgarth’s complaint is that Management made savings from the £105,000 agreed budget and used those savings to do the exact same works that Wade had costed at £60,000 but under Management’s expertise they were arranged for only £31,756. She also maintains that these additional works were not requested nor required to be done?
Management consider Mrs Hillgarth’s comments, complaints and requests to be totally invalid, including those outlined in her 14 October email, for reasons made clear to her Solicitor on multiple occasions to date, including in attached letter.
