.(Further comment/reply).......“peripheral detail” of no significance or substance!..such as whether or not a minor creditor has been paid in full - you are kidding aren’t you, as accusa- tions re monies such as these to which you refer are an integral significant heart and soul of your concern....? For £1200 read £12,000 or now Mrs Hillgarth’s £20,000 disappeared etc....! A somewhat ridiculous statement to have made I propose.
And now we have: ....You need to wake up and acknowledge the fact that you stand accused of two very serious criminal offences — namely blackmail and fraud.
The question of blackmail is easily dealt with, as you really have no answer to it. You say: “As regards blackmail, probably best you supply supporting evidence which no doubt the court officers will wish to peruse. I have no idea what you are referring to". I accept that I have not supplied copies of the original documents (l will do so at the appropriate time) but I have cited times and dates of all the relevant e-mails and have quoted extensively from them. Under the Theft Act 1968 the criminal offence of blackmail consists of making an unwarranted demand with menaces with a view to making a gain for oneself, or causing a loss to another. To be specific you were making an unwarranted demand (namely that Mrs Hillgarth should collect on your behalf the additional cash calls to the other lessees) with menaces (namely that if she failed to do so you would, amongst other things, “snip" her tenant's aerial and advise her tenant to withhold her rent). And you did that, as is now apparent, with a view to making a gain for yourself. That is blackmail, and you were unwise enough to do it in writing. The evidence is there on the record for all to see.
(comment/reply):...The question of blackmail is easily dealt with, as you really have no answer to it. Quite possibly true as it’s such a ridiculous accusation, (like the Vote Rigging accusa- tion which received short shrift as indeed does your charge of “blackmail”), initially moot- ed in your initial 23 March 2016, repeated ad nauseam in subsequent correspondence including your Draft Crime Report and the Preliminary Notice so I hope to goodness it’s not eventually considered another “peripheral detail” once disproved yet again below as indeed it has been in previous correspondence, namely:
Mrs Hillgarth is on record as having not only attended a Board Meeting in her capacity as a Director of MHML on 23 May 2014, but was requested to, and agreed to, inform all Lessees of her satisfaction with matters perused and discussed and agreed, which included a required contribution to Reserves of £2000 per Lessee to fund the AR Lawrence £109,019 agreed budget.
Mrs Hillgarth subsequently both neglected to and then refused to do so and did exactly the opposite and canvassed various lessees to withhold their £2000 contributions. Mrs Hillgarth made great efforts to confuse certain lessees with ill-informed and misguided information regarding the £2000 contribution and the two subsequent “voluntary” contri- butions for the Water Tank and Communal TV/Sky installs - all of which yet again I would remind you has been totally covered in detail, ad nauseam, in previous correspondence with you when previously first mentioned in your 23 March 2016.
But for the avoidance of doubt, I repeat my email conversations with Mrs Hillgarth of 29th September 2014 (4 weeks into the works’ schedule) as they differ from her recollections:
From Mrs Hillgarth 29 September 2014 @11.40h
Paul,
I fully understand that my tenant should not have the liberty of installing her own satellite aerial.
I am quite happy to contribute my share pay for the installation of the community aerial with the Sky+ dual cable, and it would make sense at the same time for my tenant’s installation to be removed at the same time.
If you could ask the company you have been dealing with to quote for this and let me know it seems to be the most logical solution.
Could you please also confirm whether a majority is required for this installation? Michele
