The Ratification of The Draft Law On The Elimination Of Sexual
Violence

This study discusses the strategy of the West Sumatran women's care network in pressing for the ratification of the
draft law on the elimination of sexual violence. Indonesia is still not a safety space for women. Based on Komnas
Perempuan data, as many as 299,911 cases of violence against women occurred in 2020. Then from this data, it can
be seen that sexual violence is evenly distributed in almost all parts of Indonesia, including in West Sumatra.
Referring to data released by the Central Statistics Agency in 2018, West Sumatra ranked third with 343 immoral
cases after West Java with 349 and North Sulawesi with 384 cases in the top position.
Whereas in 2019 by referring to the data released by Governmental Organization Society Women's Crisis Center
Conscience Women to mention violence against women and children reached one hundred and five cases during
2019. In November 2020 the WCC Conscience Women reported that there were eighty cases of violence against
Permian ladies, most occur in K the city of Padang with the highest cases of sexual violence. This shows that there
has not been a safe space for women. The purpose of this study was to identify the basics of choosing a social
movement strategy carried out by the West Sumatran Women Care Network (JPP SUMBAR).
That’s problem occur such as the absence of a legal umbrella that has a victim perspective so that it is still difficult
for law enforcement officers to handle cases of sexual violence. The Draft Law on the Elimination of Sexual Violence
(RUU P-KS) is one solution to uphold the constitutional mandate which affirms the guarantee of the right of every
citizen to feel safe and free from all forms of discrimination.
However, along the way, the P-KS Bill encountered obstacles such as the lack of seriousness of the policymakers in
the discussion, and especially in West Sumatra, there was still massive rejection from community groups regarding
the unequal meaning and content of the P-KS Bill. Meanwhile, on the other hand, there is no specific legal umbrella
so that sexual cases are still high in Indonesia. The state is obliged to make regulations that can eliminate stigma
and discrimination against women, one of which is through the P-KS Bill. Karen, previously I go through Act No. 7 of
1984, Indonesia has ratified the Convention on the Elimination of All Forms of Discrimination against Women.
In West Sumatra, there is a tactical network of several organizations and individuals who have joined and named
themselves JPP SUMBAR. This research uses social movement theory, namely the political process theory from
Douglas McAdam. The analysis used is stakeholder engagement analysis. In searching for data, the writer uses
qualitative methods, in which the data is obtained from the results of in-depth interviews, observations, and
secondary data collection.
The provisional findings in this study indicate that the strategies used by JPP SUMBAR are writing letters to relevant
agencies for questioning in handling cases, hearings and hearings with the W Sumatra DPRD, Focus Group
Discussions, watching movies related to gender awareness, writing articles, seminars/webinars to provide
information on gender issues. educating the public regarding the confusion of the PKS Bill campaigns to passively
issue, silent action as a form of protest, identifying influential figures such as religious leaders, cultural figures,
politicians, academics, assemblies throughout Indonesia.
Researchers found interesting strategies such as the people's assembly throughout Indonesia as a form of discourse
battle with those who rejected the PK-S Bill as well as urging the DPR-RI to immediately ratify the PK-S Bill.
However, in the discourse battle, there has not yet
been a meeting between those who reject and support the PK-S Bill to create a confrontation of ideas. So that what
happened was only the strengthening of the network from each group to master the discourse in West Sumatra.
There are still many challenges faced in the advocacy of sexual violence, such as victim-blaming in the community,
the response of law enforcement officials who have not been too gendering responsive to cases of sexual violence,
budget, and minimal facilities from the state. Because of this, the hearing action invite academics to act by the
opportunities and challenges that exist. For the current achievement, the inclusion of the P-KS Bill into the National
Legislation Program, this knowledge has begun to be supported by some people, the media have started to talk
about it substantially, not just criticizing it without basis. The difficulty in implementing this strategy is attracting
strategic allies such as religious leaders, politicians, culturalists in W Sumatra with limited access reasons.

Short Biography:
Abdis Sallam Fajri is Student of the Department of Sociology, Faculty of Social and
Political Sciences, Andalas University, batch 2017. Active in several collective movements
in West Sumatra, and has been the General Chair of the Law and Political Introduction
Student Activity Unit, Andalas University. Joined in West Sumatra Gender School.
Currently working on studies on social movements and gender.
Jendrius is a senior lecturer at Department of Sociology, Faculty of Social and Political
Sciences, Universitas Andalas, Padang, West Sumatra. He graduated doctoral program
from Gender Studies Programme, University of Malaya, Kuala Lumpur, Malaysia on 2015.
Currently, in addition to teaching and research activities, he also holds the position of
Director of Gender Studies Center at Universitas Andalas, Chair of Ikatan Sosiologi
Indonesia (Indonesian of Sociological Association) West Sumatra, secretary of Indonesian
Association of Sociology Studies Program and Indonesian Association of Gender Studies
committee.
