เป็็นสััญญาจ้้างเหมา
สััญญาจ้้างก่่อสร้้างอาจเป็็นสััญญาจ้้างเหมา (Lump Sum) สััญญาจ้้างเหมาเบ็็ดเสัร้็จ้ (Turnkey หร้ือ EPC) สััญญา
จ้้างเหมาเบ็็ดเสัร้็จ้บ็างสั่วน (Partial Turnkey) สััญญาจ้้างราคาต่่อหน่วย (Unit Price) หร้ือสััญญาจ้้างต่้นทุุนบวก่ (Cost
Plus) ฯลฯ
สััญญาจ้้างเหมา (Lump Sum) คือ สััญญาทุ่ต่ก่ลงค่าจ้้างก่ันเป็็นการเหมา เหมาเป็็นราคาทุ่เป็็นเงินจำนวนเด่ยว
โดยถืือเอาราคาเหมารวมน่เป็็นเกณฑ์์ โดยม่ขอบเขตของงานตามทุ่ต่ก่ลงก่ันในสััญญา ขอบเขตของงานทุ่ต่ก่ลงก่ันใน
สััญญา คือ งานทุ่ป็ร้ากฏตามแบ็บ็ (Drawings) และข้อกำหนด (Specification) ถื้าขอบเขตของงานไม่เป็ล่ยนแปลง ค่า
จ้้างเหมาก่็จะไม่เป็ล่ยนแปลง ยกเว้นม่เหตุ่ตามทุ่สััญญากำหนดให้เป็ล่ยนแปลงค่าจ้้างเหมาได้ เช่่น ผู้้้ว่าจ้้างสัังเพิ่่ม ลด
หร้ือให้หยุดงาน ทุำให้ผู้้้ร้ับจ้้างต่้องเสั่ยค่าใช่้จ้่ายเพิ่่มข้น หร้ือทุ่สััญญากำหนดให้ม่ค่า K ทุ่เร้่ยก่ว่าสััญญาแบ็บ็ป็ร้ับ็ร้าคา
ได้ ค่าจ้้างเหมาทุ่ต่ก่ลงก่ันก่็เพิ่่มข้นหร้ือลดลงเพิ่ร้าะเหตุ่ดังก่ล่าวได้
สััญญาจ้้างเหมาเบ็็ดเสัร้็จ้ (Turnkey หร้ือ EPC) เป็็นสััญญาจ้้างก่่อสร้้างทุ่กำหนดให้ผู้้้ร้ับจ้้างดำเนินการ้ทุังหมด
ต่ังแต่่การออกแบ็บ็ จ้ัดหาวัสัดุอุป็ก่ร้ณ์ และทำการก่่อสร้้าง ให้ได้สัิงก่่อสร้้างตามทุ่ผู้้้ว่าจ้้างกำหนด (Employer’s
Requirements) ผู้้้ว่าจ้้างเพิ่่ยง “บิิดกุุญแจ” หร้ือ “Turn the key” เทุ่านัน ดังทุ่ตำราต่่างป็ร้ะเทศฉบ็ับหน้งอธิิบายว่า
Full Turnkey
The term ‘turnkey’ is used in its original sense of being a contract under which the driller of an oil
well undertakes to furnish everything and does all work re-quired to complete the well, place it on
production and turn it over, ready to ‘turn the key’ and start the oil running into the tanks. The
expression ‘turnkey’ should only be used if the design responsibility is that of the contractor.
สั่วนสััญญาจ้้างเหมาเบ็็ดเสัร้็จ้บ็างสั่วน (Partial Turnkey) ซึ่่งก่็คือสััญญาจ้้างเหมาเบ็็ดเสัร้็จ้นันเอง แต่่งานหร้ือวัสัดุ
บางอย่างแทนทุ่สััญญาจะกำหนดให้ผู้้้ร้ับจ้้างเป็็นผู้้ดำเนินการ้ ผู้้้ว่าจ้้างก่็กำหนดทุ่จะเป็็นผู้้ดำเนินการเสั่ยเอง งานในสั่วน
นันจ้้งเป็็นสั่วนทุ่ผู้้้ว่าจ้้างร้ับ็ผู้ิดชอบ สััญญา Turnkey (สััญญาจ้้างเหมาเบ็็ดเสัร้็จ) จ้้งกลายเป็็นสััญญา Partial Turnkey
(สััญญาจ้้างเหมาเบ็็ดเสัร้็จ้บ็างสั่วน) ดังทุ่ตำราต่่างป็ร้ะเทศฉบ็ับหน้งอธิิบายว่า
Partial Turnkey
The employer undertakes certain work either directly or through consultants or other contractors
independently of the turnkey contractor, the employer will increase his level of responsibility, both for
the work itself and the coordination of that work with that for which the turnkey contractor
remains responsible. The employer may also wish to have a closer involvement in the design of, and
supply of equipment for, the production plant. But in so doing he must balance whatever advantage
he believes he gains, against the resultant diminution in the turnkey contractor’s contractual
responsibilities.
