Responsibilities
Whether you are a supervisor, manager or an employee you have
duties under health and Safety legislation to:
• Take care of your own Health and Safety and any person who may
be affected by your acts or omissions. (e.g. if you operate work
equipment, remove guards and someone uses the equipment and
is injured you could be found guilty of contributing to the accident);
• Cooperate with your employer so that they comply with their own
statutory duties;
• You must not intentionally or recklessly interfere with or misuse
anything provided in the interests of Health,Safety and Welfare in
pursuance of any statutory provisions;
DIRECTORS, MANAGERS AND SUPERVISORS
Directors, managers and supervisors need to be aware of legislation
specific to them. One key piece is Offences by Corporate Bodies
which states:-
(1) Where an offence under any of the relevant statutory provisions
committed by a body corporate is proved to have been committed
with the consent or connivance of, or to have been attributable to
any neglect on the part of, any director, manager, secretary or
other similar officer of the body corporate or a person who was
purporting to act in any such capacity, he as well as the body
corporate shall be guilty of that offence and shall be liable to be
proceeded against and punished accordingly;
(2) Where the affairs of a body corporate are managed by its
members, the preceding subsection shall apply in relation to the
acts and defaults of a member in connection with his functions of
management as if he were a director of the body corporate.
