                ABSTRACT

Over the last decade, as çArtificial Intelligenceé (AI) has become

more capable, the demand for replacing human judges by the AI or other
algorithmic decision-making systems is far greater than before. Needless to

say, AI is one of the major milestones on the way to the completed

modernization of judicial system, since AI can enhance the quality and

efficiency of judicial services in various aspects. By the way, the use of AI

in the judicial system must be in responsible manners. That is to say, the
movement toward the full-scale digitalization must be in compliance with

the right to a fair trial, which is the basic fundamental right in judicial

proceedings. This paper seeks to map out, on the basis of the right to a fair
trial, the limits of deploying AI in the judicial frameworks in order to address

                these new concerns.
