Last week, a Hillsborough County judge dismissed a lawsuit against the Hillsbor- ough County School District. The lawsuit had been filed by a group of parents who dis- agreed with the requirement of students wearing masks.
In July, the Hillsborough County School District en- acted a rule that stated all students be required to wear masks while in school. The parents, represented by At- torney Patrick Leduc, felt that they should decide if their children wore masks.
However, Hillsborough County Circuit Judge Martha J. Cook ruled last Tuesday that the school sys- tem was well within its rights to require the masks man- date because of public health interests.
The COVID-19 Pandemic struck this area of the coun-
try hard and spread quickly throughout the community. Experts agreed that the best way to fight the virus that has claimed more than 250,000 lives, was by wearing a mask, social distancing, and fre- quent hand-washing.
The school district insti- tuted its rule before the new school year began. Parents were allowed to decide if they wanted their children to con- tinue with elearning or to re- turn to the brick and mortar classroom. However, they would be required to wear masks.
Judge Cook wrote in her ruling, “The reopening plan does not infringe upon any constitutionally-protected, fundamental right, does not target a suspect class, and ap- plies to students and staff equally.”
She further stated, “The School Board had a rational basis for implementing the face covering requirement and its face mask require- ment bears a reasonable rela- tionship to a valid governmental objective.”
