A Thai national or a non-foreign juristic person as defined by the Foreign Business Act who:- assists in, aids and abets, or participates in the operation of a foreigner’s business which is classified in the lists annexed to the said Act as prohibited category to foreigners; or operates the business jointly with a foreigner in a misleading manner that he/she/it solely owns such business; or hold shares in any partnership, limited company, or juristic person for a foreigner with the intention to let the foreigner operate business by way of circumventing or violating relevant provisions of the Act. This person and a foreigner who allows the aforesaid acts to be committed by any Thai national or non-foreign juristic person under the Act are each liable to imprisonment for a maximum term of three years or a fine of one hundred thousand Baht to one million Baht, or to both.
