3) การพิัฒนาแนวทางการพิิจารณาอนุญาต่การ ประกอบธุุรกิจของค์นต่่างด้้าว ในปี 2567 ค์ณะกรรมการฯ ได้้มีการพิัฒนาแนวทางการพิิจารณาอนุญาต่การประกอบ ธุุรกิจของค์นต่่างด้้าวในธุุรกิจให้ม่ๆ ทียังไม่มีแนวทางทีชีัด้เจน ในการพิิจารณา และเป็นธุุรกิจทีนักลงทุนต่่างชีาต่ิสืนใจเข้ามา ประกอบธุุรกิจในประเทศไทยมากขึน ได้้แก่ (1) แนวทางการ พิิจารณาอนุญาต่ธุุรกิจทีเกียวข้องกับค์าร์บอนเค์รด้ิต่ (Carbon Credit) (2) แนวทางการพิิจารณาอนุญาต่ธุุรกิจขายอาห้ารและ เค์รืองด้ืม และ (3) การศึกษาประเภทธุุรกิจบริการสืินเชีือทีอย้่ ภายใต่้การกําากับ
ในรอบปี 2567 ทีผ่านมา ค์นต่่างด้้าวได้้รับอนุญาต่ ประกอบธุุรกิจ จําานวน 954 ราย แบ่งเป็น ใบอนุญาต่ การประกอบธุุรกิจ จําานวน 227 ราย ห้นังสืือรับรองกรณี ประกอบธุุรกิจภายใต่้กฎห้มายว่าด้้วยการสื่งเสืริมการลงทุน ห้รือกฎห้มายว่าด้้วยการนิค์มอุต่สืาห้กรรมแห้่งประเทศไทย ห้รือกฎห้มายอืน จําานวน 630 ราย และห้นังสืือรับรองกรณี ทีได้้รับสืิทธุิต่ามสืนธุิสืัญญาห้รือค์วามต่กลงระห้ว่างประเทศ 97 ราย โด้ยค์นต่่างด้้าวทีเข้ามาลงทุนต่ามมาต่รา 17 มากทีสืุด้ 5 อันด้ับแรก ได้้แก่ สืิงค์โปร์ ญีปุ่น ฮ่องกง เยอรมนี และ เกาห้ลใี ต่้ โด้ยธุรุ กจิ ทมี กี ารลงทนุ สืง้ สืดุ้ ได้แ้ ก่ ธุรุ กจิ บรกิ ารให้แ้ ก่ บริษัทในเค์รือในกลุ่ม (ร้อยละ 26) รองลงมา ค์ือ การทําากิจการ นายห้น้า/การค์้าปลีก/การค์้าสื่ง (ร้อยละ 24) และธุุรกิจบริการ ด้้านค์อมพิิวเต่อร์ (ร้อยละ 11) ต่ามลําาด้ับ
กรณีทีได้้รับห้นังสืือรับรองการประกอบธุุรกิจของ ค์นต่่างด้้าวต่ามมาต่รา 12 จําานวน 630 ราย แบ่งเป็นกรณีทีได้้ รับการสื่งเสืริมการลงทุนต่ามกฎห้มายว่าด้้วยการสื่งเสืริมการ ลงทุน จําานวน 548 ราย และกรณีได้้รับอนุญาต่ต่ามกฎห้มาย ว่าด้้วยการนิค์มอุต่สืาห้กรรมแห้่งประเทศไทย จําานวน 82 ราย โด้ยค์นต่า่ งด้า้ วทเี ขา้ มาลงทนุ มากทสืี ดุ้ 5 อนั ด้บั แรก ได้แ้ ก่ ญปี นุ่ จีน สืิงค์โปร์ ฮ่องกง และไต่้ห้วัน โด้ยธุุรกิจทีมีการลงทุนสื้งสืุด้

business. By removing the said businesses that are on the list 3 (21) annexed to the Act, it will be issued as a ministerial regulation.
3) Development of guidelines for consideration of permission the business’ licenses; in 2024 the Commission has developed guidelines for considering permits for foreign business operations in new businesses that there are still no clear guideline to consider and are businesses that foreign investors are increasingly interested in doing business in Thailand, including: (1) guidelines for considering permission for businesses related to carbon credits (Carbon Credit) (2) guidelines for considering licenses for businesses selling food and beverages and (3) study for the loan service businesses that are under supervision.
In 2024, a total of 954 foreigners have obtained permission as follows: 227 foreigners for the Foreign Business Licenses; 630 foreigners for the Foreign Business Certificates under the investment promotion scheme, under the law on the Industrial Estate of Thailand or under other laws; and 97 foreigners were issued under the privilege provision of the treaties or international agreements. This year the top 5 foreign companies investing in Thailand are from Singapore, Japan, Hong Kong, Germany and Korea. The business categories in which they are most invested are ordinary services provided to affiliated and intra-group companies (26%), brokerage/retail/wholesale (24%), and computer services (11%) respectively.
As mentioned earlier, 630 foreigners granted Foreign Business Certificates which can be divided into 2 groups: 548 were granted under the investment promotion scheme of the Investment Promotion Act, 82 were granted under the Industrial Estate Authority of Thailand Act.
