FORECLOSURE MEDIATION

CHECKLIST FOR HOMEOWNERS

A. Referral to mediation by housing counselor or attorney

B. Send documents to mediator and beneficiary

✓ 23 days after notice of referral from Department of Commerce

C. Send $300 mediation fee to mediator

✓ 30 days after receiving notice of referral from Department of

Commerce or per mediator’s instructions

D. Beneficiary sends documents to mediator and homeowner

✓ 20 days after receiving homeowner’s documents

E. Prepare Homeowner Mediation Notebook (see next page)

✓ Prior to mediation

F. Day of Mediation Session

✓ 70 days after the Notice from Department of Commerce

✓ Borrower and beneficiary representative required to attend in person.
✓ Department of Commerce requires all borrowers who signed
promissory note to attend session or provide written power of
attorney if one borrower is not attending (exceptions can apply for
successors-in-interest). Arrive early.
✓ Dress appropriately
✓ Inform the mediator and beneficiary ahead of time if someone will be
attending the mediation with you.
