In regard to the referenced equipment and the work being performed by NES/WES, you have provided direction
to our service personnel to undertake certain repair or maintenance actions which are contrary to or in conflict
with the technical instructions of the equipment manufacturer as well as NES/WES recommended repair or
maintenance procedures and processes. Before we undertake to comply with your specific directives, this is to
remind you and confirm that our limited warranties with respect to the services we provide do not cover and do
not provide remedies for the correction of defects, malfunctions or conditions to equipment on which such
services are provided arising from the consequences of services not in compliance with manufacturer or NES/
WES recommendations, substandard or incomplete repairs made at your request and direction, or with parts or
components (new or used) furnished by you or third parties and installed by us at your request.
NES/WES will accommodate your request and direction to perform such services, which you acknowledge as
being given by signing below, and further agree to release and hold harmless NES/WES from any claims for
damages or losses of any kind, whether based on warranty or negligence, arising from the consequences of
services provided by NES/WES not in compliance with manufacturer or NES/WES recommendations, or
substandard or incomplete repairs made at your request and direction, or with parts furnished by you or third
parties and installed by us at your request.
