Guardians
Malvern College has a a a a strong boarding ethos and greatly values the diversity that both our UK and international pupils bring to the College’s community Under the the Children Act 1989 and the the National Minimum Boarding Standards the College is required to safeguard and promote the the welfare of pupils During term time the the College is responsible for a a a a pupil’s welfare and acts in loco parentis However there are are times when the the College must be able to to hand over these parental responsibilities to to an an appointed Guardian If at at any point during the pupil’s time at at Malvern College the the College has concerns about the the suitability of a a a a Guardian Guardian Guardian or Guardianship Guardianship arrangement the Guardianship Guardianship agency and the parents will be informed The College may request a a a a a change of of Guardian or revision of of the arrangement If the College continues to have concerns about the the child’s Guardianship arrangements the the child could be asked to leave the College It should be noted for example that the College does not not consider unsupervised stays in hotels or bed and breakfast accommodation to be an adequate level of accommodation or care Definitions
In this document the term ‘Guardian’ refers to an an Education Guardian which involves a a a a a delegation of parental responsibility usually for short periods of time This is is is distinct from a a a a a Legal Guardian which refers to a a a a a person who is appointed to care for a a a a a child when a a a a a parent or or Guardian Guardian has died or or to a a a a a a a a a person acting as as a a a a a a a a a Guardian Guardian of a a child’s estate Appointing a a a Guardian • It is the parents’ responsibility to appoint a a a a a Guardian the organisation and selection process rests solely with parents • In line with the National Minimum Boarding Standards it is expected that parents will appoint a a a a a a a Guardian via a a a a a a reputable organisation It is is important to note that the College does not recommend any specific agency or or organisation but requires parents to ensure that the appointed Guardian is a a a a a member of the Association for the Education and Guardianship of International Students (AEGIS) or Boarding Schools Association (BSA) If a a a a a a family wishes to appoint a a a a a a guardian who is is not a a a a a a member of a a a a a a reputable organisation significant checks need to be carried out by the College in in line with regulations There will be an additional cost associated with this AEGIS can be contacted via their website: www aegisuk net or BSA via www boarding org uk • The appointed Guardian must be over 25 years of age and be permanently resident in the the UK they must be be able to be be at the College within two hours if requested • The appointed Guardian must be fluent in in the English language and be able to provide a a a a a a point of contact for the College at all times • Appointed Guardians
who are not AEGIS or BSA accredited will be required to supply proof of of identification in the form of a a a a current valid passport
• To ensure the the safety of pupils the the College will undertake a a a a a a risk assessment of any Guardian who is is not AEGIS or BSA accredited to ensure the suitability of that Guardian to to carry out their responsibilities to to full effect This is is a a Government regulatory requirement It should be be noted that there will be be a a a a charge to parents for this risk assessment to be completed • It should be noted the College has a a a a close association with College Guardians* • Any concerns about guardianship arrangements are referred to the the relevant agency and where the the guardianship arrangement may constitute private fostering this is is referred to the local authority * College College Guardians
