ARTICLE X

SWIMMING POOLS, SPAS, ETC.

All swimming pools, spas, hot tubs, fountains and waterfalls are required to be
constructed in compliance with approved design specifications and must be fully
screened or fenced. Single family home pools must be screened. Above ground pools
are prohibited. Such swimming pools, spas, hot tubs, etc., shall be installed only with
the full understanding that neither the Association nor the Board of Directors shall be
held liable for any claim, damage, injury or death, occurring as a result of using such
facilities, regardless of whether the user(s) is authorized to utilize said facilities.
