California Alert - AB 5 Signed Into Law

Governor Gavin Newsom signed into law AB 5 (Gonzalez) on September 18, 2019. AB 5 is intended to codify the
California Supreme Court "Dynamex" decision regarding the classification of an independent contractor versus
employee. The new law takes effect on January 1, 2020.
Licensed private investigators are excluded from the "A-B-C test" of AB 5. It cannot be understated that the fact that
licensed PIs have been excluded from this law is a tremendous accomplishment. Under the leadership of legislative
advocate Jerry Desmond and Government Affairs Committee Chairwoman Francie Koehler, CALI has achieved the
profession's greatest legislative accomplishment during my 25 years of active membership.
Our profession would no longer operate under it's current model if licensed PIs were not excluded from AB 5! For
example, assignment opportunities posted on the CALI listserve would require the "hiring" of an investigator rather than
"retaining" an investigator to accomplish the task. Every licensed PI in California has benefited from the investment of
CALI members towards our profession's legislative advocacy. "Tell a friend"
Every licensed private investigator in California that is active in or cares about this profession should be a CALI member!

Iowa probe finds thousands of ‘guard cards’ wrongly issued

A state public safety employee was terminated and may face legal action after it was determined that at least 5,817
“guard card” licenses were issued to companies on behalf of the private investigators, security guards or other
uniformed personnel they employed without national background checks

Colorado’s PPIAC Seeks Association Support – PI Licensing Facing Sunset Repeal
Members,
You may be aware that Colorado's private investigator licensing law is due to sunset in September 2020. The
Department of Regulatory Agencies who oversees and issues PI licenses in CO, released a recommendation on October
15, 2019 to sunset the law due to a lack of public harm. The Professional Private Investigators Association of Colorado is
at work to ensure the continuation of PI licensing.
PPIAC is seeking letters from other state PI associations in support of licensing. Having letters of support detailing
reasons why PI licensing is important for the protection of the public will be helpful for PPIAC's endeavor. Colorado's
legislative session begins in early January.
If your state association would like to send a letter of support, please submit it to robert@api77co.com and PPIAC's VP
of Legislative Affairs Robert Orozco will compile and forward the letters to the appropriate law makers.
