Guide for Liability Insurance
If the workman dies a natural death while on duty, no
liability attaches to the employer unless it is proved that
the death was caused by strains and stresses peculiar
to that particular employment. When the death of the
workman is caused by aggravation of a pre-existing
disease due to an accident, it is held that the death has
resulted from the accident.
There should be a causal relation between the accident
and the duties which he is required to perform by the
employer. The act should not be foreign to the
employment.
Q9. On payment of additional premium, the basic
coverage under the Public Liability (Industrial)
insurance policy can be extended to include
liabilities which are excluded by the policy.
Appropriate extra endorsements are attached to
the policy.
Following are the extensions of coverage on payment
of extra premium:
(a) Pollution coverage - the policy can be extended to
cover liability for:
(i) Death or bodily injury.
(ii) Loss of or physical damage or destruction of tangible
property.
