the date when the first claim of the claim series event
was made in writing against the insured. Claims series
event is defined as a series of two or more claims arising
from one specific common cause with this attributable,
e.g,- (i) to the same fault in design, manufacture,
instructions for use or labelling of products (ii) to the
supply of same products and services (iii) to products
and services showing the same defect.
For e.g, a defect in a particular batch of injections may
result in injuries to large number of people simultaneously
or one after another. All claims the club together for the
purpose of applying the limit of indemnity for anyone
accident. Thus, the indemnity limit applies to any one
claim or a series of claims arising from one originating
cause. The clause also provides for a time limitation.
Claims arising from one specific cause made after 3
years after the first claim of the series, are not covered.
(a) Products Liability Policy - A Claims Series Event is
defined as a series of two or more claims arising from
one specific common cause which is attributable e.g, (i)
to the same fault in design, manufacture, instructions
for use or labeling of products or (ii) to the supply of the
same products and services, or (iii) to products and
services showing the same defect.
