                                     Unworkable from practical standpoint requiring courts to engage in
                                     an exhaustive examination of whether add’l material in envelope
                                     constitutes information relevant, helpful or prejudicial to borrower



                              Nothing in RPAPL 1304 prevents a lender from mailing IN OTHER
                              ENVELOPES notices to borrowers - whether federally mandated or
                              consisting of other notice or information



               DISSENT VIEW OF STATUTE - common sense and strict statutory construction is
               inconsistent with the majority’s view; absent an explicit prohibition against such
               additional language in a valid RPAPL 1304 notice, the statute should not be
               extended beyond its plain language
