Nothing in RPAPL 1304 prevents a lender from mailing IN OTHER
ENVELOPES notices to borrowers - whether federally mandated or
consisting of other notice or information
DISSENT VIEW OF STATUTE - common sense and strict statutory construction is
inconsistent with the majority’s view; absent an explicit prohibition against such
additional language in a valid RPAPL 1304 notice, the statute should not be
extended beyond its plain language
