Are You Struggling with a Marijuana Policy?
With state regula ons changing daily regarding the use of marijuana, businesses are struggling with what
they need to do to protect both their
businesses and their employees.
Federal law s ll classi es Marijuana as a Schedule I drug.
Even though marijuana may be used
beyond work, there is s ll a strong case
for a drug-free environment since as
soon as the employee comes to work,
he/she becomes the responsibility of the
company. So far courts have supported
employers’ e orts to maintain a drug-
free workplace. In the 6th US Court
Circuit of Appeals, “private employees
are not protected from disciplinary ac on as a result of their use of medical marijuana, nor are private employers required to accommodate the use of medical marijuana in the workplace.”
Federal law requires drug tes ng for safety- sensi ve transporta on workers such as pilots, school bus drivers, truck drivers, train engineers, subway operators, aircra maintenance personnel, transit re-armed security personnel, ship captains, and pipeline emergency response personnel, among others.
