Employers should be aware that the presence of THC (the ac ve ingredient in marijuana) in the body may not indicate someone is presently impaired. While an employee may only feel the e ects of marijuana for a ma er of hours, THC can be detected for several days—or even weeks—if the employee
is a frequent user.
Make sure you have communicated your policy to all employees and clearly stated what is expected of them.
Train your managers about
con den ality rela ng to sensi ve employee informa on—including drug-test results and requests for accommoda ons for medical condi ons for which marijuana is prescribed (especially under state law).
If you choose
to have a zero- tolerance policy, you should be prepared to answer addi onal ques ons. How will you handle employee recrea onal use permi ed by law? Will you look to federal law to
jus fy a true zero-tolerance policy? Are you an organiza on required to abide by federal law?
