• The draft Proof of Evidence should be submitted by the company’s lawyers to two or three
   laymen who are not familiar with the case. They should be questioned on their understand-
   ing, and the Proof of Evidence revised if necessary.

The procedures outlined above should result in clear-cut and simple evidence, and not, as
often happens, in technical gobbledegook which confuses the judge, jury and even other
expert witnesses.

Conclusions

The cunning plan is already flexible but you should adapt it to suit your personality and
style. However you do it, getting to the deep truth is 95 per cent preparation and 5 per cent
