APPLICATION FOR ASSISTANCE OF A M KENZIE FRIEND
                                                                                              C
                                                                       PART 5:CHRONOLOGY OF INSURANCE CLAIMS
                    63. Throughout the Summer and Autumn of 2016, Kingsley Napley and the Claimant
corresponded regularly on the information required for disclosure to Diamond Insurance.
The AIG personal accident policy was not disclosed by either the Claimant or easyJet.

                    5.11 FIRST PAYMENT FROM CIRENCESTER

                    64. On 4 and 17 May 2016 the Claimant received his first cheques from Cirencester Friendly
                                    th
                            th
totalling £3,843.06 as compensation for his loss of shift and other variable benefits . He
                                                                                                  43
knew that under the subrogation and related terms of the Cirencester Friendly policy,
benefits should come to an end when he found any form of alternative employment or
received other compensation for loss of earnings.

                    65. No evidence has come to light that the Claimant advised Cirencester Friendly of his
compensation of £525,397.60 from AIG [on 28 October 2016] or his income from
                                                                   th
                        trading Land Rovers.

5.12 FLOUNCE AND RETURN: SEPTEMBER 2016
                    66. In September 2015, the Claimant went again on sick leave. He was under pressure and
very difficult to live with. His relationship with LPJS was strained and he moved out of
Nutley Place to stay with friends. LPJS suspects he had second thoughts because he was
                                   44
broke, unemployed and had nowhere to live. He returned – very contrite - to Nutley
Place after a couple of days and he and LPJS tried to rebuild their relationship .
                                                                                              45
                    67. In September and October 2016, the Claimant was paid £144,890.92 by easyJet and
                                                                                      46
£250,046.00 by Hiscox for loss of his licence. The payments improved his mood, but
only in the short term. He was still anxious about the Diamond Insurance claim which he
viewed as his “windfall” and “life changer”.

                    5.13 EVENTS OF OCTOBER 2016
                    68. On a date unknown – but before his employment terminated - he must have submitted a
claim under his personal accident policy with AIG.

                    69. On 18 October 2016 at 09.08.00 the Claimant emailed Ms Kerry Coote of easyJet
                             th
                        stating ;
                              47
“I am chasing about the claim I have with AIG. The personal accident claim I have with

                                                               48
into this for me?. Should you need any further information or details about the claim I

43 He received PHI benefits from easyJet until November 2016 and from Cirencester until at least May 2018
44 At that time never making any claims to a financial interest in Nutley Place
45 He admitted that in the interval he had searched for a house to rent
46 Arranged via Kerry Coote of JLT
47 This detail is important, because the Claimant later misdescribed the AIG policy as a loss of licence. He knew this
                    to be untrue.
