PART 8: DETAILED COMMENTS
15 LOANS TO COVER MAINTENANCE SHORTFALLS
The Claimant is currently arguing that funds that he disbursed to cover school fees and defaults
by APMS in his maintenance payments were loans to LPJS “secured on Nutley Place”.
224. A table produced by the Claimant sets out details of alleged loans – amounting to
£80,164.01 - that he said he made to LPJS to cover defaults in APMS’s maintenance
payments and school fees. In fact, by his own admission, the Claimant made the loans
directly to APMS. His email of 3 October 2016 to APMS states:
rd
“…..like last month, I will lend you another month of maintenance you are court
ordered to pay for Louise and the children. This is my money which I will lend you for
now, because I don’t want to see your children suffer “
16 ABANDONED PROPERTY
When the Claimant flounced from Nutley Place in July 2018 he left behind many items of
personal property, incomplete, defective DIY projects and unpaid bills.
225. Leaving Nutley Place was entirely the Claimant’s decision and the consequences his
188
responsibility. He subsequently returned to the house on multiple occasions and with
LPJS’s agreement removed many items.
226. He also called back in the week of 26 July 2018, while LPJS was at work, let himself
th
in through the closed but unlocked back door, interfered with her computer and
distressed her daughter and son. LPJS’s son – Tom - called the police and the incident
was recorded in official logs and the Claimant cautioned. The Claimant removed
property without leaving any receipt.
227. The Claimant alleges that he left behind all of his flying logs for the past 20 years.
Outside the Court on 14 August 2019, the Claimant’s barrister said that he required the
th
logs urgently for a regulatory inspection. LPJS’s barrister asked to be sent details of the
alleged inspection. These were never sent, yet months later there has apparently been no
complaint by the regulator of non-compliance.
228. LPJS believes that the Claimant removed the logs (which were essentially rough diary
notes rather than formal documentation) prior to or during his visit in the week of 26
th
July 2018. The house has been searched from top to bottom and the logs cannot be
found.
229. On 21 August 2018 at 1821 the Claimant emailed MJC stating that “private
st
paperwork had been removed from his files” before they were returned to him. He has
never repeated that allegation.
230. In October 2018, with LPJS’s cooperation, the Claimant sent a van to Nutley Place and
removed property; again, it was not fully catalogued.
188 And contrary to all of his promises
