Surviving the Police
I am not an attorney. I do not work for any political organization pretending to
have the interests of Black folks at heart. And more importantly, I am not afraid
of the police. I have had encounters with the police on the streets, in airports, on
airplanes, in bus stations, at road blocks, in restaurants, in parking lots, at
concerts, on interstates and in prison. I have dealt with cops while dirty and while
being accompanied by my family.
I am sure that by you knowing more about the police you will feel more
comfortable and respond differently. There is no need to be afraid or over-react.
You should be prepared for the worse when dealing with cops. This type of
preparation involves you being physically and mentally sound. While in California
penal system, the brothas would always say, “Stay ready - Ain´t gotta get ready”.
So, when you are out and about you should know that you are a target.
I have tens of police stories and yet, I have not shared any. Thus, I will start by
saying that a police officer is not considered a “person”. The reason this matters
is because a police officer’s peace cannot be disturbed and the laws for
disturbing the peace do not apply to a police officer.
This means that you can say anything to a police officer as long as a civilian does
not hear it. As you know, it is quite easy for a police officer to justify a lawful
arrest by having witnesses claim that your form of speech distrubed the peace.
This is the time when you need video and audio readily available on your cell.
If you are arrested, there is no need to cooperate with the arresting officers
because he only wants to get credit for an arrest. If you confess to wrongdoing,
you will only assist the officer. Its okay to be courteous, but do not figure that
manners will make you appear civil to a cop.
In terms of Miranda Rights, it is posible for an officer to read your rights and walk
away. Upon returning, he can start talking and questioning as if he never read
you your rights and cause you to ignore your right to remain silent or avoid
incrimination. Understand that a cop does not have to read you your rights, but
what you say during that period should be considered inadmissible in a court of
law. If you are read your rights and decide to talk, you can stop talking at any
point.
