Federal Legislative Watch From NCISS
Congress has not seen any significant in legislation, such as The PRO Act. This is good – however, our profession cannot
let its guard down. Once the summer recess ends, and they reconvene in the fall, it will again be all hands-on deck.

Colorado and Other State Legislative News
The Colorado legislature, again – like 2020 – ended the session early, despite requirements of our state constitution. In
addition, and at a very accelerated pace, various records were set for the introduction and passing of laws – and laws
signed by the governor. This includes the new consumer privacy bill – one of three nationwide (CA and VA being the
other two). The other was the automatic sealing of criminal records. In general, and with specific exclusions, this will
automatically seal most misdemeanor and felony criminal records in a designated period of time (3 years for
misdemeanors and 7 years for felonies) after a person has completed any sentencing imposed, and has not had an arrest
or conviction during that time. It would also automatically remove any arrest information without charges after one
year. This includes all court and law enforcement (local and Colorado Bureau of Investigation) and prosecutor records.
These would not be allowed used in an employment or housing background check, or civil or criminal process. The intent
of this law will not be addressed, and the unintended consequences PPIAC members testified to, will be realized.
