Chapter 6




               Condition:

                    A vital term of the contract

                    Innocent party has the choice of cancelling the contract and claiming damages
                     or continuing with the contract and claiming damages

               Warranty:

                    A less important term which is incidental to the main purpose of the contract.

                    Only remedy for breach is a claim for damages.


               If it is unclear whether the term should be a condition or a warranty then the courts
               will classify the term according to the consequences of a breach.
