The law of employment

The contract of employment

An employment contract is like any other contractual relationship. The basic
rules of contract will apply.

Therefore, in a contract of employment, the following applies:

 The employer offers employment.

 The employee accepts the offer of employment.

 Consideration is present in the form of the remuneration package provided by
the employer in return for the work of the employee.

 Clearly this is a business agreement (as opposed to a social or domestic
arrangement) and the parties are presumed to intend legal relations.

Express terms

Express terms are those agreed by the parties themselves. Their agreement may be
written or oral.
