Judgment Enforcement – The Step-by-Step Course



                    Step 4: When you get the Assignment and Agreement Back


                       ✓  You make a copy of both the Assignment and the agreement for your file.


                        ✓  You file the original assignment only with the court.

                       ✓  When you send it to the court, or take it in, ask the court for a “Conformed Copy.”
                           (A conformed copy is the court stamped copy, showing it has been filed.  You want
                           that as proof, in case the case file is lost — yes, it happens.  So, when you send the

                           Acknowledge to the court, include a copy for them to conform and mail back.)
                       Remember, once the original creditor has assigned the judgment to you, you are the
                    assignee. [Webster’s dictionary defines “assignee” as “the person to whom something has

                    been assigned, such as a person to whom a right or property has been transferred.”
                    “Correct pronunciation is assignEE.”]
                       That’s precisely what happens here: All rights, title, and interest in this judgment have
                    been transferred to you. It’s yours! That means that, as the assignee, in the eyes of the court
                    you are the NEW judgment creditor. You stand in the shoes of the original creditor.
