GLOSSARY OF IMPORTANT TERMS
Abstract of Judgment: A legal document stating the basic facts of the
judgment – when it was entered and how much it was. The Abstract of
Judgment is the document you apply for at the court and then record at
the county recorder to put a lien on the debtor’s real property in that
county. A different abstract is needed for each county where the
debtor has real property.
Return Service Requested: The phrase to write under the return
address of a letter in order to make sure the letter is not forwarded, but
instead that the Post Office provide you with the new address of the
person you are looking for.
Agent for Service of Process: Corporations are required to designate
someone as the Agent for Service of Process. This is the person
(usually an attorney or an officer of the corporation) who accepts
service of court documents for the corporation. If you need to serve a
corporation with a Plaintiff’s Claim, JDX, or other paper, this is the
person to serve.
Alter Ego: Literally, “Another Self.” It often refers to an individual
who is mixing his own assets or expenses with the corporation’s. This
is illegal. For example, if a person starts a corporation and then uses
the corporate bank account to pay for his own expenses, then the person
is really “another self” of the corporation. Both the corporation and
the individual then can be made liable for the debts of the corporation.
Appeal: A new hearing of all of the claims by the superior court.
Appropriate Fee: Appropriate court and sheriff fees will vary from
state to state and even from county to county. Be sure to check with
your court and sheriff’s department to learn the correct fee for your
legal actions.
