Commissioner: A Small Claims Court commissioner is an attorney
hired by the court to hear Small Claims Court cases.
Conformed Copy: An exact copy of the document filed at the court,
and it is stamped by the court. It is your proof that the
court received the document. Sometimes (and more than just
sometimes) the court loses paperwork. If you have requested a
conformed copy when you file your paperwork, it is your proof that it
was filed.
Contempt of Court: The deliberate obstruction of a court proceeding
by refusing to obey a court order. It is sometimes punishable by a fine
or imprisonment.
In actual practice, however, I find that judges can be quite lenient,
especially when it’s “only money,” as one judge said to me. The first
contempt offense they will often waive punishment. But the judges do
want the court to be respected.
Creditor: The person who is owed money.
Creditor’s Claim: The claim a creditor makes on assets of a deceased
debtor.
Debtor: The person who owes the money.
Default Judgment: A judgment entered against a person or company
that failed to appear and defend himself at the trial.
Demand Letter: A letter mailed to the debtor that tells the debtor he
must pay the money by a certain date or you will start action against
him.
Application for Earnings Withholding Order: The legal document
you fill out and give to the sheriff to garnish someone’s wages.
Dismiss with prejudice: To dismiss the present action, and deny the
right to file another suit on that claim.
