Judgment Enforcement – The Step-by-Step Course

BACK AT THE OFFICE
Let’s say you are back from the courthouse or found some cases on one of the
professional databases (I’ll get to that), and you have information about at least a couple of
court judgments, maybe even ten or more. This next step is a very important one that will
probably save you lots of time and hassle.
At this point there are two schools of thought about how to proceed.
Method #1 of Taking Judgments: Contact the Creditor right away
After a JE finds a judgment, they will often right away call or write the creditor take
assignment on the judgment and then try to enforce it. [That’s what I did too, when I
started.]
Method #2 of Taking Judgments: Investigate First!
Don’t rush off and take assignment. Instead, investigate the JD to
determine if he or she is a better debtor. You’re screening the
judgment to find out if it’s likely to be a good one. And, if you
decide to accept the judgment, then after it’s in your name (not
before) pull a credit report on the JD. Do this after you take assignment but before you file
the judgment with the court. If it doesn’t look profitable now, just return it to the creditor
