Judgment Enforcement – The Step-by-Step Course
Me: Here how it works. You assign the judgment to me. Then you and I have a separate
agreement that showing that I am purchasing the judgment from you for 50% percent of
its value, with payments to be deferred until collection begins.
Mrs. G. Well, I haven’t gotten anything so far, so I guess I could try it. But what if you
can’t collect?
Me: If I can’t collect, I would be happy to return the judgment back to you. If I can’t
enforce it, I don’t want it on my desk.
Mrs. G: Okay. Can you send me some stuff to look at?
Me: I would be happy to. I’ll email you today.
Writing to the Creditor?
Again, I strongly recommend calling. I know people who spend
$100 on stamps and letters a month. Better to put the money into
database costs.
But, if you choose to send a letter offering your services, then:
Okay, it’s obvious. Your letter must be professional-looking. Use
decent quality stationery and be certain your message is accurate and clear. Neatness
counts. No misspellings or smudges. This letter is the only thing the creditor has to
evaluate you. Be sure to include your email and website. The creditor will very likely look
you up on the Web. Your Website must be top-notch. It must provide an excellent presence
for you and your business.
Put the name of your company at the top of the letter, as well as the address, phone
number and website. You’ll also want to include your business card, of course. Get good
quality business cards from a reputable printer. I get mine from Vistaprint.com. They are
pretty nice!
It’s important that your letter to the creditor pretty short, that it shows the creditor your
professionalism, and that it is quick and clear to the creditor that this is a no-risk
opportunity to get the judgment enforced. You should say that the terms of your agreement
are based on a percentage of the value of the judgment. There is a sample letter on the
Forum under “Peter’s Course Files” #18, in MSWord. Handy dandy. Check it out. And
notice that the letter is quite short and easy to read quickly. It is also easy on the eyes, with
extra spacing between paragraphs. It is meant to invite the creditor to read it.
