5) The following point arises for my consideration;
“Whether the petitioners have made
out grounds for grant of anticipatory
bail?”
6) My answer to the above point is in the
af irmative, for the following;
R E A S O N S
7) It is the case of the prosecution that the petitioners
being the Directors along with others f oated a company by
name “Canopy Estates Private Limited” and had commenced a
housing project named “Canopy Classic” in Survey No.43/3 of
Banaswadi village, K.R. Puram Hobli, Bangalore East Taluk, to
build 2-3 bedroom f ats ranging from 1155 Sq. feet to1555 Sq.
ft. in the year 2010 by notifying the public, who evinced interest
in the project together to provide with amenities of club house,
play area, basket ball court, gym and pool. It is stated in the
complaint that the complainant in advance had paid to the
company and accordingly expecting the temporary possession of
f ats, but there was delay from the company. It is further stated
that booking charges was between Rs.2 lakhs to Rs.12 lakhs and
the agreement of sale of undivided share in the land and
construction agreements were executed in their favour by the
company. It is further alleged in the complaint that the delivery
of f ats from the date of plan sanctioning varied from 24 months
