I. DISCIPLINARY ACTION
1) Any employee engaging in the use of alcohol while on HEPACO’s property, or worksite or
who reports for duty under the effects of alcohol is subject to disciplinary action up to and
including termination.
2) Any employee using or abusing medications prescribed by a physician and/or over-the-counter
medications to the extent that job performance or fitness for duty is adversely affected while on
HEPACO’s property, worksites or while on company business will be removed from the work
place and/or disciplined up to and including termination.
3) Any employee engaged in the use, possession, purchase, sale or transfer of any illegal drug
while on HEPACO’s property or worksites or while on company business will be removed
from the work place and/or disciplined up to and including termination and may be subject to
criminal investigation and/or prosecution.
4) If an employee is arrested or convicted for DWI, DUI or for violation of a criminal drug statute,
the employee must notify HEPACO within five (5) days of the arrest. HEPACO’s designated
official will determine the best course of action to be undertaken for the benefit of HEPACO
and the individual. The individual may be disciplined up to and including termination
depending on the circumstances.
J. EMPLOYEE ASSISTANCE PROGRAM
If an employee has a problem with alcohol or drugs, he/she is encouraged to seek help by contacting
Branch Manager. Requests for help will be kept confidential.
Participation in the Employee Assistance Program will not prevent disciplinary action against an
employee who is found to be in violation of this policy.
K. MISCELLANEOUS NOTES
1) This Substance Abuse Policy primarily governs HEPACO’s actions in the area of alcohol,
drugs or other controlled substances. Other company policies may be applicable in this area to
the extent they do not conflict with this policy.
2) In any of the selection or testing situations described in this policy, if prescription drugs are
detected and the applicant or employee is able to prove medical or professional authorization
for the prescription, HEPACO reserves the right to contact the individual’s physician or
professional, or HEPACO officials may send the individual to HEPACO’s physician for
verification and review of the situation.
