3) No part of this policy nor any of the procedures thereunder is intended to affect HEPACO’s
right to manage its workplace, to discipline its employees or guarantee employment, continued
employment or terms or conditions of employment. The Substance Abuse Policy and
Procedures in no way create an obligation or contract of employment. HEPACO reserves the
right to alter or amend the program at any time in its sole discretion.
4) An applicant or prior employee will not be denied future employment with HEPACO solely
because of a prior positive test for illegal drugs or alcohol, provided he or she, in HEPACO’s
opinion, has successfully completed a drug rehabilitation program and has a negative result of
their pre-employment drug test.
5) Employees who test positive, as well as those who advise HEPACO that they have a drug
related problem, will be directed by HEPACO to appropriate agencies where treatment may be
received.
6) If any part of this policy is determined to be void or unenforceable under state or federal law,
the remainder of this policy, to the extent possible, will remain in full force and effect.
