County Board of Supervisors seeks hearing o cers

The Tulare County Board of Supervisors is seeking interested individuals to serve as County Hearing Officers. On April 30, 2019, the Board adopted an ordinance providing certain appeals be reviewed by a County Hearing Officer instead of the Board of Supervisors. Persons who are dissatisfied with administrative reviews provided by an individual department may appeal to the County Hearing Officer. The types of appeals that would be reviewed by a County Hearing Officer, rather than the Board
of Supervisors, include actions regarding transient occupancy tax decisions, code violation fines, public nuisance violations, animal citations, and others outlined in the ordinance.
County Hearing Officers will conduct a full administrative hearing of appeals and will issue a written decision. Any appeal from the Hearing Officer*s decision would go directly to court. The Clerk to the Board of Supervisors will coordinate scheduling of County Hearing Officers.
To be eligible for the position of County Hearing Officer, an applicant must hold an active
license to practice law in the State of California. To avoid conflicts of interest, attorneys who provide legal services to the County of Tulare will not be eligible to serve as a County Hearing Officer. In turn, County Hearing Officers will not be eligible to provide any other legal services to the County of Tulare, other than those of a Hearing Officer.
The County Hearing Officer is a paid position, and the County is looking to hire a rotating panel of at least five Hearing Officers. Each Hearing Officer will be an independent contractor. The newly approved
ordinance authorizes the County Administrative Officer to enter into a contract with a Hearing Officer on a flat rate or hourly basis, with reimbursement for actual and necessary expenses, as agreed to between the County of Tulare and the Hearing Officer.
Administrative hearings presided by County Hearing Officers will be held at the County Administrative Office, located at 2800 W. Burrel Avenue in Visalia.
