案件分享 高雄電擊法鬥案
INVESTIGATION CASE TASER ABUSE CASE
4月19日下午，Taiwan SPCA(社團法人台灣防止虐待動物協會)接獲一起高雄市三民區法鬥遭惡意 電擊之案件。從影片可看出，行為人拉著狗項圈，限制狗狗逃脫範圍，並施以電擊，不顧狗狗的掙扎 與哀求而電擊了兩次，甚至發出嘻笑聲。狗狗因不堪而吐水。調查部門與民眾確認案件狀況後，立即 聯繫高雄市動物保護處。當晚，高市動保處、警方、與熱心民眾已至現場帶出受虐的法鬥，並送至動 物醫院檢查。也請行為人前往派出所說明案件狀況。此案涉及違反《動物保護法》第六條:「任何人 不得騷擾、虐待或傷害動物」。有故意傷害或使動物遭受傷害之嫌，依故意、過失以及情節的嚴重程 度，有不同的罰則。若致動物肢體嚴重殘缺、重要器官功能喪失或死亡，將處一年以下有期徒刑或拘 役，併科新臺幣十萬元以上一百萬元以下罰金。根據此案的狀況，行為人故意傷害動物，未達動物肢 體嚴重殘缺、重要器官功能喪失或死亡，亦應處新臺幣一萬五千元以上七萬五千元以下罰鍰。經過調 查部門連日與動保處的聯繫，目前已經檢查完犬隻的健康狀況，將持續追蹤後續的開罰狀況。
In April, a case was reported to us regarding a dog being tasered by his owner in Kaohsiung. In the video evidence, a man is seen tightening the dog’s collar to keep it from escaping and then shocking it with a taser. He did not stop when the dog was wailing from pain and he even laughed after doing so.
The dog then threw up from being shocked with electricity.
TSPCA contacted the Kaohsiung City Animal Protection Office and was told that they had rescued the dog in the video with the police and reporters. The dog was sent to the vet hospital and the man was called in for questioning. According to the Animal Protection Act article 6, anyone who mistreats or harms an animal shall be sentenced to imprisonment for no more than one year or a fine of not less than one hun- dred thousand TWD and not exceeding one million TWD. In this case, the man may be fined 15,000 to
75,000 TWD.
