Right to die - Right to life does not include right to die. (Aruna Ramachandra Shanbaug v Union of India, AIR 2011 SC 1290 : (2011)4 SCC 454).
Mercy killing or Euthanasia - Active euthanasia is crime all over the world, including India. It is a crime under Section 302 or at least under Section 304 of the IPC. (Aruna Ramachandra Shanbaug v Union of India, AIR 2011 SC 1290 : (2011)4 SCC 454); Common Cause (A registered Society) v Union of India, 2018(2) Supreme 164 : AIR 2018 SC 1665.
Validity of passive Euthanasia upheld. Active Euthanasia continues to be illegal. (Common Cause (A Registered Society) v Union of India, AIR 2018 SC 1665 : 2018(2) Supreme 164).
Right to life encompasses fair procedure. (Ranjitsing Brahmajeetsing Sharma v State of Maharashtra, AIR 2005 SC 2277 : (2005)5 SCC 294.
Fair trial demands that copy of documents exhibited/unexhibited filed in Court during trial should be given to accused, if demanded. (V.K. Sasikala v State by Superintendence of Police, 2013(3) Kar. L.J. 83 (SC) : AIR 2013 SC 613 : (2012)9 SCC 771).
“Due process of law” includes fairness in trial. (Sidhartha Vashisht alias Manu Sharma v State (NCT of Delhi), AIR 2010 SC 2352 : (2010)6 SCC 1).
Non-examination of witnesses due to threat, coercion, etc., denial of fair trial. (Zahira Habibullah Sheikh v State of Gujarat, AIR 2006 SC 1367 : (2006)3 SCC 374).
Fair trial - The failure to hear material witnesses is certainly denial of fair trial. (Himanshu Singh Sabharwal v State of M.P., AIR 2008 SC 1943 : (2008)3 SCC 602).
Fair trial - Covers interest of prosecution, accused and victim. (Asha Ranjan v State of Bihar, AIR 2017 SC 1079 : (2017)4 SCC 397).
Fair trial includes fair investigation. A victim is entitled to fair investigation of the case also. (Nirmal Singh Kahlon v State of Punjab, AIR 2009 SC 984 : (2009)1 SCC 441).
Fair trial is heart of criminal jurisprudence. To examine if non-compliance has caused prejudice to accused - Rattiram v State of M.P. through Inspector of Police, AIR 2012 SC 1485 : (2012)4 SCC 516.
Concept of fair trial, cannot be stretched limitlessly. (State of Haryana v Ram Mehar, AIR 2016 SC 3942 : (2016)8 SCC 762).
Right of privacy - What one eats is one’s personal affair and it is a part of his right to privacy included in Article 21. (Hinsa Virodhak Sangh v Mirzapur Moti Kuresh Jamat, AIR 2008 SC 1892 : (2008)5 SCC 33).
Right to privacy - Aadhaar Card - Held, it is not mandatory for a citizen to obtain Aadhaar card for getting benefits to which a citizen is entitled to. (Justice K.S. Puttaswamy and Another v Union of India and Others, 2017 SC 4161 : (2017)10 SCC 1).
Right to life includes freedom from noise pollution. (In Re: Noise Pollution, AIR 2005 SC 3136 : (2005)5 SCC 733).
