Jury duty or witness pay is not utilized for the purposes of calculated non-exempt overtime, unless specifically required by law. In order to receive jury duty pay, the employee must present a statement of jury service and the statement of pay to their immediate manager.
Erbe does not reimburse employees for time away from work where the employee is a party in a court proceeding. Such employees are free to avail themselves of accrued vacation time for such absences, if necessary.
10-7. Military Leave
Erbe recognizes that employees may need to be absent from work to serve in the U.S. or state military. Erbe provides military service leaves of absence to all regular full-time and part-time employees in compliance with the Uniformed Services Employment and Reemployment Rights Act (USERRA) and Georgia’s Reemployment in Private Industry Law. Employees that reside outside of Georgia should refer to Erbe’s Human Resources Portal and their state-specific addendum for any additional rights pursuant to other state laws.
Human Resources is responsible for the administration of this policy. Employees who have questions regarding this policy or questions about military service leave that are not addressed in this policy or applicable state-specific addendum on the intranet, should contact Human Resources.
Employees who need to take military service leave, should provide (or have authorized military service officer provide) advance notice to Erbe’s Director of Human Resources. When possible, employee’s should give at least 30 days’ notice of the request for leave. If 30 days’ notice is not possible because of military necessity or for other reasons, employees should give as much advance notice to Erbe as possible.
Written notice via email to derrick.roy@erbe-usa.com is preferred. Where possible, please submit a copy of the military orders, training notice, or order to active duty to the Director of Human Resources.
Eligibility and Service Requirements
All regular full-time and part-time employees are eligible for military service leave if they are absent from work because of eligible military service.
For purposes of this policy, eligible military service means certain types of service (listed below) in the following branches of the U.S. or state military:
Armed Forces (Army, Navy, Air Force, Marine Corps, and Coast Guard), including the Reserves;
National Guard, including the Army National Guard and Air National Guard, when the employee is engaged under federal authority in active duty for training, inactive duty training, or full-time National Guard duty;
Commissioned corps of the Public Health Service;
Any other category of persons designated by the President in time of war or national
emergency; or
An organized militia or reserve component as defined under Georgia law.
