c. When the completion and continuation of work started before eight (8) hours is necessary to
prevent serious obstruction or prejudice to the business operations of the hotel.
d. When overtime is necessary to avail of favorable weather or environment conditions where
performance or quality work is dependent thereon.
e. Other circumstances allowed by the Labor Code.
4. For overtime work, an additional compensation equivalent to his regular wage plus at least twenty-five
percent (25%) thereof. Work performed beyond eight hours on a Holiday or rest day shall be paid an
additional compensation equivalent to the rate of the first eight hours on a holiday or rest day plus least
thirty percent (30%) thereof.
5. Compensation on Rest Day and holidays shall be in accordance with the following provisions under the labor
code:
a. If an employee is permitted to work on his scheduled rest day, he shall be paid an additional
compensation of at least Thirty Percent (30%) of his regular wage.
b. Worked perform on any special holiday shall be paid an additional compensation of at least thirty
percent (30%) of the regular wage of the employee. Where such holiday falls on employees’ rest
day, he shall be entitled to additional compensation of at least fifty percent (50%) of his regular
wage.
c. Work performed on a Legal Holiday shall be computed as Regular Daily Rate plus 100% thereof.
d. Work on Legal Holiday falling on an employee’s rest day shall be computed as Regular Daily
Rate plus 130% thereof.
e. For any of the above work rendered exceeding eight hours (8), the employee shall be entitled to
a 30% additional on top of the premium rates given.
6. HRD shall release memo as to the declared Regular Non-Working Holidays and Special Non-Working Holidays
for the employees’ reference.
7. Every employee under manpower agency shall be paid a night shift differential of not less than (10%) ten
percent of his regular wage for each hour of work performed between ten o’clock in the evening and six o’
clock in the morning.
8. Employees shall be paid Thirteenth Month Pay at the end of the year on or before December 24 of the current
year.
9. Employer shall have their share for the SSS, Phil. Health, Pag-ibig monthly contributions of each and every
employee.
10. Every manpower agency employee who has rendered at least one year of service shall be entitled to a yearly
Service Incentive Leave of Five (5) Days with pay.
11. Pregnant Employee who has rendered at least six (6) months for the last twelve months, is entitled for a
Maternity Leave of at least (2) weeks prior to the expected date of delivery and another Sixty (60) days after
normal delivery and (72) days for cesarean delivery and shall only be paid for the first four delivery provided
that the following were completed by the employee:
a. That the employee shall have notified the manpower agency of her pregnancy and probable
date of her childbirth, which notice shall be transmitted to the SSS in accordance to the rules
and regulations it may provide.
b. The full payment shall be provided by the employer within thirty (45) days from the filing of the
maternity reimbursement and delivery medical records needed as attachments.
