An overview of right-of-entry laws in the State of New York and
adjoining states, the practical necessity and standard practice by
land surveyors, and the legal aspect of property access from both a
trespassing and safety/injury liability perspective.
By the end of this session participants will be able to:
1. Explain the right of entry of Land Surveyors in New York.
2. Explain the right of entry of Land Surveyors in adjoining states.
3. Apply “best practices” of right-of-entry, including notifications,
safety, and conflicting resolution.
About our Speaker
Mr. Donald Groesser is a professional land surveyor
with more than 40 years of experience in all phases
of land surveying operations, including research,
fieldwork, construction control and staking,
boundary analysis, legal descriptions, and
completion of final plats and documents for ALTA/
NSPS Land Title Surveys, boundary surveys,
topographic surveys, route surveys, pipeline surveys,
aerial control surveys, preparation of various statutory plats and other
conveyance documents. He has held positions from entry-level rod man,
instrument technician, survey technician, project manager, department
manager and small business owner. Mr. Groesser was the Corporate Survey/
Geospatial Practice Lead for CEC from 2017-2025. In this role he provided
oversight for CEC’s Survey/Geospatial Practice operations of 22 CEC offices,
including 186 Survey/Geospatial Practice Staff Members, with 40
professional land surveyors licensed in 31 states. At CEC this is a 3-5 year
appointment, which Don filled for over 7 years. Don’s broad experience
includes such notable projects as recent ALTA/NSPS Land Title Surveys for
two project sites in central PA totaling 1100 acres intended to be used for
power supply for mega computer systems used for bitcoin digital mining;
an ALTA/NSPS Land Title Survey for a former steel plan in northern Kentucky
of approximately 700 acres bounded by railroads and the Ohio River, which
incorporated UAV imagery for depicting existing conditions and
documenting the demolition progress; and boundary and utility surveys for
the development of a 2,800 solar farm in Southwest Pennsylvania.
